Conference sparks hope for ocean health

Environmentalists were encouraged by the attendance last week of President Clinton and Vice President Al Gore at the nation’s first National Ocean Conference in Monterey.

Clinton promised $224 million in support of various plans to improve the oceans’ health and extended the current ban on offshore oil drilling in California and most of the country’s other coastal states for 10 more years. He also announced new initiatives to reduce overfishing and for improvements to the nation’s harbors.

Marine biologists and other ocean experts hailed the ideas, but most said the money was just a drop in the bucket.

Former White House Chief of Staff Leon Panetta said of the oil-drilling ban, “At some point we need permanent protection. But this is an important step.”

There are 28 oil-drilling platforms off the California coast from Santa Barbara to Long Beach, built between 1950 and the early 1980s. Their oil makes up only 4 percent of the nation’s yearly production. Drilling was banned forever on the central coast with the creation of the Monterey Bay National Marine Sanctuary, the nation’s largest protected ocean area at 350 miles long.

Part of the $224 million would be spent to build sustainable fisheries. The National Marine Fisheries Service estimates that of 727 major marine species in U.S. coastal waters, the status of only 38 percent is known. Of that number, one-third are overfished. Clinton proposed measures to ban the sale and importation of Atlantic swordfish, rebuild fish stocks and develop technology to reduce bycatch (sealife unintentionally caught in nets).

Clinton also said he would push Congress to fund his $2.3 billion Clean Water Action Plan to reduce pollution flowing into streams and oceans.

Of interest to activists opposing the Navy’s low-frequency active sonar tests was Gore’s proposal to complete an ocean-monitoring system and the declassification of nonsensitive military data, which would be used to help track marine mammals and detect illegal fishing. He said such data would also help predict deadly storms and increase knowledge of climate change.

Environmentalists say the LFAS tests have noticeably affected whales that migrate to Hawaii to birth their young. When tests were conducted off the central coast last year, several dead whales washed up on beaches within days of the first transmission, which were temporarily halted. The noise tests were permitted to resume several weeks later and have continued off the coast of Hawaii.

After studying a report in the journal Nature by biologist Dr. Alexandros Frantzis, which correlates the LFAS tests and strandings of Cuvier’s beaked whales in the Mediterranean Sea in May 1996, Jean-Michel Cousteau has stated his opposition to the tests. Frantzis’ article states, “Although pure coincidence cannot be excluded, it seems improbable that the two events were independent.” Using stranding data collected over the last 16 years, he computes the probability of a nonmilitary cause for the stranding at less than 0.07 percent.

Using this information, environmental groups attempted to block the tests, but in March, a U.S. District Court judge in Hawaii denied the request for an injunction and allowed testing to go forward.

Scientists for the Navy disagree and accept a certain amount of “collateral damage” from testing. The National Marine Fisheries Service also allows a certain arbitrary “take” of marine mammals during military exercises.

Local environmentalists are wondering whether the unusual numbers of dead seals and sea lions along our coast this year may be related in part to the sonic tests. (See related story on this page.)

Seals, sea lions beach in record numbers

It is the height of the marine mammal stranding season and on Friday, a fairly typical day, Malibu’s Wildlife Emergency Response co-directors Rebecca Dmytryk and Aaron Frank respond to a call on Malibu Road for a shark that had beached itself.

When the volunteers arrived, it had returned to the sea but was swimming in circles just beyond the surf zone. Dmytryk is in contact with experts by cell phone. They say the shark has the best chance to survive if it stays in the sea, rather than being removed, and they don’t have a tank for it anyway. It is a thresher shark, about 6-8 feet long, with a long tail and red dorsal fin. If it beaches again and dies, Dmytryk says they would want to do a necropsy to find out what killed it.

A few hundred yards down the beach is an elephant seal pup basking quietly in the sun and flipping sand over its back. “It’s skinny, but for this year, it’s way better than most we see . . . maybe a little dehydrated,” says Frank, explaining that seals come up to rest on the beach naturally. “There was one two days ago that had a wound on its abdomen. It was about the same age and size as this one, but I can’t tell if it’s the same one unless it turns over.” He guesses its age at about 3 or 4 months.

“They are born in March or April, nurse for one month only, then are on their own,” he says. “El Nino has caused major changes in their food supply.”

Post-mortem studies are being done on sea lions this year because of the extraordinary numbers of deaths. “Marine mammals are sentinels for what’s happening. They’re our link to the ocean, at the top of the food chain,” Frank says.

Sea lions are opportunistic feeders, but seem to prefer squid and anchovies. “This year, it’s not clear what they’re feeding on,” Frank says. “Some are doing well, but we’re seeing at least two to three times as many dead as in ordinary years. Some are malnourished, but others appear well fed.”

Some of the sea lions that beached in recent months had seizures, which Frank says could be caused by toxic pollution, mercury poisoning or algae blooms. “That’s why we’re studying tissue samples of their major organs. But we need some support for the studies. The necropsy lab results are sent to Maryland to the Armed Forces Institute for pathology and NMFS.” With some financial support, WER volunteers hope to be able to develop lab facilities here.

Residents are encouraged to call WER at 456-WILD to report beached marine mammals. By law, the animals cannot be moved or disturbed in any way before they have been observed for 48 hours. Some malnourished or injured pups are transported to facilities in San Pedro for treatment before they are released back into the sea. WER is also recruiting volunteers and providing training for rescue work.

Septic systems under study again

The Los Angeles Regional Water Quality Control Board has directed the City of Malibu to conduct a technical investigation to determine the impact of discharges from wastewater and septic tank systems.

In a letter to Mayor Joan House, the board’s executive officer stated the regional board is concerned that heavy reliance on the use of septic systems in densely populated portions of the city of Malibu threatens water quality and contamination in Malibu Lagoon and adjacent beaches is of particular concern since it results in a public health risk.

The technical investigation must address four specific questions:

1) What are the impacts from septic systems for which the city is responsible, including the septic system at 23555 Civic Center Way?

2) What are the cumulative impacts from the city’s septic systems, as well as from other septic systems?

3) How effective are the city’s current regulatory efforts in mitigating public health risks and other water quality impacts from the discharges from septic systems?

4) What additional measures are needed to remedy impacts that are not adequately addressed by existing regulatory efforts?

A draft work plan for the technical investigation is due July 10. It must include a detailed methodology and a schedule for determining impacts from septic systems and a summary of the city’s current regulatory efforts to ensure existing septic systems have been properly sited and are properly functioning. Also, by June 26, the board requires a list of all septic system dischargers in the Malibu Valley, including the Malibu Colony.

City staff and board staff have held some preliminary meetings to “try to come to some sort of an understanding of what it is they want to have happen,” said City Manager Harry Peacock. Peacock said the meetings are intended to determine “what they’re expecting and how we can work collectively.” Peacock said the board will be invited to attend a City Council meeting in order to discuss the matter, probably in July.

Yes, it’s very charming to see happy doggies frolicking in the waves with their clueless owners. It’s also oh-so-groovy to let your dog run free in my neighborhood and yours. But Malibu is no longer the empty playground it once was. Now there are more neighbors, more traffic and dog owners need to obey laws designed to protect the interests of everyone.

Not so charming was the recent death of a lovable Jack Russell terrier when it was run over by a pickup on my street. Other free-running dogs have been known to spook horse riders on the trails causing very dangerous situations. The solution? Keep your dog in your yard or on a leash when walking on the roads

The anonymous writer of “Copping a flea” (June 4) was completely in the right when yearning for a designated dog beach but was completely in the wrong when knocking the cops who were doing their job citing dog owners on the beach. These cops need and deserve our support. There is a statewide leash law and many beaches prohibit dogs. Why? Poop, for one thing. Not once have I witnessed a dog owner pick up a mess left by their own animal on a Malibu beach. Not once. There is poop on the sand and rocks and it gets in the ocean further contaminating the water.

As members of the Wildlife Emergency Response team, my wife and I frequently observe dogs chasing sick sea lions and injured elephant seal pups back into the water. In the Malibu Lagoon a large chow runs freely, chasing birds completely out of the area. These are offenses against the law and the peace of the wildlife. I sure wish our free-spirited dog owners would control their animals, obey the laws, support the police and protect the right of others to enjoy the splendors of Malibu in peace. Now that would be groovy.

Minimum wage debate goes local — Kuehl tells restaurateurs tip credit less than appetizing

Seeking relief from recent increases in the minimum wage, Malibu restaurateurs met with Assembly Speaker Pro Tem Sheila Kuehl (D-Santa Monica) last week to lobby for a change in state law that would allow employers to use a portion of an employee’s tips to meet the minimum wage requirement.

California is one of only seven states that does not permit employers to pay tipped employees less than the minimum wage, and then to claim a portion of an employees’ tips to make up the difference. Federal law permits employers in states that have a “tip credit” to pay tipped employees half the minimum wage, as long as an employee’s tips will bring up the pay to the hourly wage requirement.

The California Restaurant Association has been fighting for years to restore the tip credit, which was eliminated in the 1970s under then-Gov. Jerry Brown. But the association has stepped up its efforts recently after four minimum-wage increases in the past two years has brought California’s minimum wage to $5.75 an hour. The association is encouraging its members to lobby their legislators for a tip credit.

But Kuehl told the restaurant owners and managers, who gathered at Geoffrey’s Friday to press their case, that she did not support a restoration of the credit.

“The employer-employee relationship should be a win-win for both,” said Kuehl. “I haven’t seen any way that a tip credit is a win-win.”

She also expressed doubts that a majority of legislators would support such a change either.

“I don’t believe very honestly that that will change any time soon,” she said.

Nonetheless, Kuehl said, if restaurant owners could present convincing arguments that the lack of a tip credit was detrimental to their businesses, some movement on the issue may be possible.

“When the stage is set with a minimum-wage employee versus a very successful business, it’s very difficult to make your case,” she said. “If you want me to be your advocate, then you need to give me the ammo.”

Jeff Peterson, who organized the meeting at Geoffrey’s, where he is general manager, said the restaurant has paid more than $50,000 in wage increases in the past year because of changes in the minimum wage laws, and, he said, his restaurant has a very slim profit margin to show for it.

“I don’t have the money [for the wage increases],” said Peterson, who is also the president of the Malibu Chamber of Commerce. “I’ve raised the salmon money. I’ve raised the price of beverages.”

Undaunted by Kuehl’s lack of enthusiasm for restoring the tip credit, Peterson told the Malibu restaurant owners, including the proprietors of BeauRivage, Marmalade and Moonshadows, that he wanted to form a committee to push for a change in the law.

“We have to do something,” he said. “Because if Gray Davis comes into power, you can bet that the minimum wage will go up to $6.50 or $6.75.”

El Nino may be over, but cleaning up the damage it left behind could go on for months and possibly years. A beachfront home along Broad Beach, clobbered by pounding surf, has already been demolished, and a pair of homes on Las Flores Mesa overlooking PCH may be next in line. Caltrans is working to finalize plans to purchase and tear down the two structures, said to be caving in under a landslide. Officials for the agency fear the properties could come crashing down on Pacific Coast Highway, posing a danger to motorists.

The storms of ’98 caused havoc throughout the area, but Calle del Barco and Malibu Road were hardest hit — at least as far as city coffers are concerned. On a long list of needed repairs, the two locations make up what City Manager Harry Peacock calls “the big-ticket items.”

Correcting a slope failure at Calle del Barco is expected to run in excess of $1 million. Along Malibu Road, several storm drains need to be replaced, portions of the roadway need to be repaired and landslides need to be stabilized. Here too, repairs could top $1 million.

As far as private property is concerned, Broad Beach took the biggest beating — with a total of six homes receiving red or yellow tags. The homeowners are now in the process of evaluating whether they can make the necessary repairs. Other red- and yellow-tag designations were handed out on Malibu Road, Villa Costera and on the 20400 block of Pacific Coast Highway.

According to the city manager’s office, the total for debris removal, emergency response, temporary measures and permanent repairs will add up to $3.65 million. Considering Malibu’s unique vulnerability and compared to other areas, city officials say the area came through fairly well. “It could have been worse,” Peacock observed, “a lot worse. But I’m just glad it’s over.”

Did you know that dolphins are so intelligent that within only a few weeks of captivity, they can train humans to stand at the very edge of the pool and throw them fish. I happened to be commuting by Zuma Travel located in the Point Dume Shopping Center when I noted the dolphin emblem in the window. Zuma travel is owned and operated by Marjorie Hollinrake. I met Marjorie and her husband, Jerry, shortly after my arrival in Malibu in 1970; they have resided in Malibu since 1961. I was president of the Malibu Soccer League for several years (later merged into the AYSO) and coached their son Mike, then a young teen-ager, in the fine grace of not being embarrassed when routed by a successful defensive soccer action by Kimmy Flood. Mike was tall, quick and strong so the girls in the league (yes, girls and boys played on the same teams) delighted when they could garrison against his onslaught towards the soccer goal. Kimmy Flood is now 26 and about to be married in September, so I thought I’d drop in to visit with Marjorie and see how her son Mike, 28, was doing and gossip about the “old days”.

Marjorie and other travel agents in the office, Lynda Marsolek, and Helen Algreen follow my Malibu Times letters to my neighbors and provided me the following actual stories told to them and other Zuma Travel agents over the years. Marjorie received a call from a client inquiring about a package to Hawaii. After going over all the cost information, the customer asked if it would it be cheaper to fly to San Francisco and then take the train to Hawaii? (glug glug)

Helen received a telephone call from a Malibuite who wanted to go to Capetown. Helen started to explain the length of the flight and the passport information when the Malibuite interrupted her with, “I’m not trying to make you look foolish, but Capetown is in Massachusetts.” Without trying to make the Malibuite look like the stupid one, Helen calmly explained, “Cape Cod is in Massachusetts, Capetown is in Africa.” Her response — click.

A secretary for a jet setter from New York called Zuma Travel looking for hotel reservations in Los Angeles. She gave Lynda various names off a list, none of which she could find. Lynda finally had her fax Zuma Travel the list of hotels. To her surprise, it was a list of hotels in New Orleans, Louisiana. A young Malibu starlet called and said, “I need to fly to Pepsi-cola on one of those red-eye specials.” Marjorie asked if she meant to fly to Pensacola on a late night flight. The response, “Yea, whatever.”

Maybe now I understand why the Zuma Travel logo is a dolphin. Dolphins sleep at night with one eye open.
