Malibu Measure R is dead … the state Supreme Court has refused to review its death.
Bikers are angry that the City of Malibu is not paying them proper deference.
The city issues a road repaving schedule … work starts Monday.
And .. a major court decision on beach access could have Malibu impacts.

Malibu’s Measure R is dead … has been for months … and now it’s buried.
The state Supreme Court has decided there is no legal issue to be changed …. or error to be fixed … in the decision by two lower courts to kill Malibu’s Measure R.
Drafted by attorneys working for Michelle Reiner and Rob Reiner … and passed by voters in 20-14 … Measure R was an attempt to do two things.
It attempted to limit the number of chain stores in Malibu.
And it would have required large commercial building projects to go out for a vote of the people.
Measure R was illegal on both of those two fronts … said the lower courts.
Now the Supreme Court of California says … there’s no reason to even consider overturning those two rulings.
Chain store limits across the state … in places like Carmel and Del Mar … are now in jeopardy … because of the Malibu decisions.
The courts have ruled it is illegal to regulate chain stores based strictly on the type of tenant … as opposed to the use of the space.
And voters do not have the right to veto a shopping center that meets all city zoning and planning department rules ….
The courts say the voters can set the rules… but they can’t act as judges to say yes or no.
Measure R cannot be appealed to the U-S Supreme Court .… as there is no federal issue.
And this decision leaves only one hurdle to the construction of the Whole Foods supermarket on Cross Creek Road …. and that is the mandatory widening of Pacific Coast Highway at Malibu Lagoon.
That has to be done before the shopping center can be opened.
Caltrans has reportedly approved plans for that controversial project … which includes squeezing in a right turn lane on PCH at the Shell gas station at Cross Creek Road.
The death of Measure R apparently is a major setback for slow growth advocates in Malibu … but the city’s zoning code and the state’s Local Coastal Program are the most restrictive in the state … commercial landowners say.

Organizers of a September biker motorcade through Malibu … and beer bash at Bluffs Park … are firing back at city of Malibu staff and the L-A County sheriff.
The Run To The Flags is still scheduled for September 12 … but it doesn’t have any city permits.
It’s a 15-minute long line of motorcycles … and it is still planned by ride organizers to run red lights and block intersections on P C H in western Malibu next month.
But it doesn’t have permits from the city … or the sheriff’s department.
In a long letter to the city … that we got ahold of yesterday … the group vigorously disputes conclusions from the city that the ride was disruptive.
The group says it is not safe for a group of 1 thousand motorcyclists to follow traffic laws … because stopping to let other motorists use the highway at traffic lights is dangerous to the bikers.
The statement complains that the city has not paid proper deference to the bikers…. and has raised the issues with the Run To The Flags too late.
Says the ride organizer … and we quote … “having worked with Malibu Parks & Recreation department in official capacity over the past three years, we firmly believe that the timing of this event does not confound the city.”
Last year’s rally and party at Bluffs Park jammed traffic completely for a half day … starting with a bike procession that took a half hour to park and get out of the busy intersection of Malibu Canyon Road at PCH.
There was a crash there … and the residual traffic jam lasted all day.
The issue goes before the city council on Monday.

After two weeks of requests from a news reporter … the City of Malibu has rescheduled its repaving scheduled for streets in western Malibu … and issued a schedule of what to expect and when.
Street resurfacing on many streets will begin next week … the exact schedule is posted at the city’s website …. and we have a link to that at the KBU Radio Malibu dot net website.
On Monday morning … paving crews will be at work on Bonsall Drive … Filaree Heights … Flori Heights … Harvester Road … Lunita Road and Westward Beach Road.

The Santa Monica Airport will have both ends of its one and only runway chopped up… this fall.
The Santa Monica City Council Tuesday approved a 3.5 million dollar contract to shorten the sole runway at the municipal airport by more than a third,.
That will end nearly all jet takeoffs and landings … a move that neighbors have long sought.
The F-A-A has already signed off on shortening the runway from 5 thousand feet to 35-hundred feet …
Ending jet operations is the first step in an 11 year timetable to close the airport … which is the closest general aviation field to Malibu.

The Silicon Valley billionaire who locked the gates at a popular beach near San Francisco must open them to the public.
And the state Court of Appeal ruling will have far-reaching impacts on other coastal access cases.
At issue is the California Coastal Act … and public access to the ocean across private land.
The Surfrider Foundation says the legal issue can be boiled down to “Can wealthy individuals buy up our beautiful beaches and say, ‘Screw you, you can’t walk to the water any more?’”
Lawyers for the billionaire say coastal access is a violation of his private property rights.
The challenge could go to the heart of the California Coastal Act, passed by voters in 1972, and redefine when and how the public can access California beaches. They are expected to appeal to the state Supreme Court, and eventually perhaps, the U.S. Supreme Court.

The entire community is invited to watch high-definition video from NASA’s 12 reporting stations coast-to-coast, 57 high-altitude weather balloons, astronomical telescopes, and even the International Space Station.
Doors open at 10AM on Monday, August 21 at the Malibu Jewish center and Synagogue.
They’ll have the entire total eclipse — from the time it hits the Oregon coast … at 10:15 …until it passes over Charleston, SC 90 minutes later.
