That zombie traffic light on PCH goes out again … the Caltrans exorcists have fixed it.

Malibu will put the brakes on chain stores … again.

But that has the shopping center lawyers  rattling their chains.

A parks agency in negotiations to buy the gateway to Malibu … now slated to become a subdivision.

And a member of the Rindge family dies.

This is Malibu’s only local daily news.

It’s the   ((((  Tuesday   ))) edition of the news … from Radio Malibu  …. 97 point 5 K B U.

Good morning Cottontail Lane.

Zombie PCH Traffic Light Dies (Again), Nightmare on Malibu Street

For at least the sixth time this year … the brand-new traffic signal controller on Pacific Coast Highway at the Bell air Bay club failed this morning.

Traffic was bad heading into Malibu …. but just a Halloween nightmare heading into Santa Monica during the morning rush-hour.

Some motorists reported a one hour 45 minutes drive into Santa Monica this morning.

The bad light was the one just east of Sunset Boulevard.

The private Belair Bay Club has driveways on both sides of the highway … and paid for new signals installed there more than a year ago.

The new signals have failed repeatedly … and Caltrans electricians have spent days trying to find the problem.

The lights went out before 6:30 and were repaired just before 8:30.

Traffic backed up all the way to the Malibu Pier … it took more than an hour to sort that out.

Son of Chain Store Ordinance Rises From Dead

Second verse … same as the first.

The city Planning Commission voted 4 to 1 last night to go ahead with restrictions on chain stores in Malibu’s shopping centers.

The proposed ordinance … which has to be approved by the city council … would limit new chain stores to about 30 percent of any shopping center … although supermarkets and drugstores and banks would be exempt.

The ordinance is similar to Measure R … which was approved by a 3 to 2 landslide by Malibu voters.

The courts had problems with one small aspect of Measure  R’s chain store rules … and tossed the whole thing out.

The new ordinance follows the court’s road map … and the city attorney says it would pass muster at the courthouse.

Marshall Camp is the attorney for a shopping center owner … the one who successfully got Measure R thrown out.

He told the planning commission last night that they are still treading on very thin legal ice.

NEWSCART 77167 CAMP :14 on a legal grey zone.

“In our view there is no formula retail ordinance of this kind that can be immune or impervious to legal challenges.

“These sorts of ordinances exist necessarily as it is right now in al legal grey zone.”  [END QUOTE]

That not very subtle threat was accompanied by a request from the shopping center owners to … in their words … work together on this issue.

Advocates from the preserve Malibu side of the issue were not amused.

J. Flo Katz spoke later.

NEWSCART 77143 JFLO 111 :08 QQQQ: but we’re going to sue you.

“I just find it really ironic, that the lawyers come up and they say ‘it would be great if we all work together’ but we are going to sue you.” [END QUOTE]

Other shopping center owners argued that the American economy is changing … and telling shopping centers what kinds of tenants they can have is not a good thing.

Here’s the Malibu Country mart’s Blake Pomeroy.

NEWSCART 77137 POMEROY :16 QQQ: less permanent tenants.

“Retail is changing very rapidly.

“The Internet is wiping out entire business sectors.

“Placing additional restrictions on our ability to lease

to different tenants would inevitably lead to more vacancies,  more pop-up stores and less permanent tenants.”  [END QUOTE]

But they weren’t the only ones making thinly veiled … not quite threats.

Again … J Flo Katz …

NEWSCART 77140 JFLO 222 :07  QQQ we’ve learned a lot.

“A ballot is not off the table, a ballot can be done again. very easily, we’ve learned a lot. “

The Planning Commission made a few mostly technical adjustments to the proposed chain store ban.

They voted against language from the city attorney … in terms of defining shopping centers.

They replaced that with language from the original Measure R.

The proposed chain store restrictions goes on to the city council… for a final decision.

Dog Ate Our Homework On District Divorce

Dozens of parents from Malibu … and other concerned citizens … attended last night’s school board meeting in Santa Monica.

The topic … splitting Malibu out of the unusual two-part district.

KBUU News was covering the Planning Commission.

We’ll have a report on the school board meeting tomorrow.

Stake May Be Driven in Kanan Road Subdivision Plans

KBUU News has learned a parks agency is in negotiations to buy a key piece of land along Kanan Road … at the gateway to Malibu ftom the north.

The Triangle Ranch is currently planned to become a subdivision.

It sits on both sides of Kanan Road at Cornell Road … just south of the suburban strip malls of Agoura Hills.

There have been back and forth fights over housing projects planned for the 38 acres for more than a decade.

It sits at the bottom of Boniface Mountain  … along Medea Creek … which feeds Malibu Creek.

It is viewed by conservationists as a key acquisition … at the gateway to the Santa Monica Mountains National recreation Area … and Malibu.

The web of agencies headed by Joe Edmiston is now in negotiations to buy the Triangle Ranch.

No price or terms mentioned yet … it may be voted on behind closed doors by the M R C A — the Mountain Resource Conservation Authority — at a meeting in Thousand Oaks tomorrow.
