“Panicked” Homeowner Endangers Public Drawing Gunfire On PCH
Controversy swirls about yesterday’s running gunfight down P-C-H.
A man who lives on Yerba Buena Road … in the Ventura County mountains west fo Malibu … confronted a trespasser on his ranch at 3:30 yesterday morning.
We’ll let the homeowner … pick up his story.
Carl Wilson related the chain of events to Fox 11’s Gigi Garcette yesterday morning.

“And he wrestled the gun from me, and then he started shooting at me.
“I ran and hid behind his truck and he fired three rounds at me.
“And then took off.
“So I went up to the hosue and got a 12 gauge .
Threw it into my car nd searched th eneighborhodd for him.
so I srated pursiing him and calling 911 and when I got close enough he started leaning out the window like a bank robber and started shooting at me out the window of his car … right here on PCH.
“Then he brake checked me and I missed him, and then he brake checked me a second time and I hit him real hard.
“That was basically the end of it.
“So he fired six rounds at me on PCH and three rounds at my own house .… at me.
GARCETTE: “With your own gun?”
WILSON: “Yeah.”
Carl Wilson … the Malibu resident who used his vehicle as a weapon against a trespasser …. triggering gunfire from the driver ahead of him.
Was that a good idea???
We pose that question to Captain Garo Kuredjian … the sheriff’ spokesman for the Vnetura County sheriff’s office.

“I would say no.
“This puts the victim in danger, obviously, as well as others in danger, because those rounds that the suspect fired, although not striking the victim, could have hit somebody else.”
As for Carl Wilson … the Ventura County sheriff’s office is investigating.
There is no indication that the D-A in either L-A or Ventura County will examine the incident.
Wilson told Fox 11 he was foolish to have grabbed a gun …. and then gotten so close to the suspect … that the suspect could grab his gun.

“I was too foolish and got too close.
“I couldn’t think clearly because I was panicked and I used poor judgment.
“ I got to close to him.
“I I didn’t want to shoot him, I didn’t want to kill him.
“I just wanted to hold him until the officers could arrive.
“I hate bad people and I don’t like them to get away, and I will do whatever I need to do to keep them from getting away.
“And I don’t care.”
Wilson apparently thought nothing of drawing additional gunfire from the man speeding away … and even followed close enough to be forced into a rear ender twice.
California law allows a homeowner to use deadly force … a gun … a car … to defend oneself from violence.
Chasing a suspected burglar is not self defense.
Drawing gunfire from a man who has already shot at you … not self defense.
Engaging in a car chase … not self defense.
Gunman Escapes From Crash, Schools Get Extra Patrols
Yesterday’s gun chase incident caused a large alarm at schools and neighborhoods near Zuma Beach.
The criminal case is the responsibility of the Ventura County sheriff’s office … although local deputies from Malibu-Lost Hills flooded the area for the search.
The search was over … the bad guy got away well before dawn.
Sheriff’s deputies now say that in hindsight … they should have made it clear that they believed the suspect was long gone before schools started.
By midmorning … deputies were sent to Malibu High and Juan Cabrillo schools as a show of force.
The perimeters of the campus were patrolled …
Parents were reassured by deputies that there was no gunman lurking in the area.
The L-A deputies were caught in what they call a very strange case … being handled by another police agency … the Ventura sheriff.
And Ventura’s P I O says they were not aware this happened next to the schools.
The city of Malibu and the high school put out statements at midday … calming parents and saying there had been no threat at any time.
All of this can be traced back to a man … losing his handgun to an invader …. getting shot at… and thus causing fear and confusion in the community.

B and B Regulations Need Teeth, Planning Comm Says
A proposed ordinance that would have tightened rules on B and Bs in Malibu went down in flames last night at the Planning Commission.
Commissioners were upset that the proposed city ordinance does not protect Malibu homeowners … or permanent tenants.
A whole line of people stood up last night to testify how important overnight rentals was … to their pocketbooks.
Others decried their cul de sacs turning into hotel parking lots for party houses.
Planning commissioner Jeff Jennings said the whole idea of a blanket permission for citywide overnight rentals was a bad idea.
He says property owners should have to apply for permits … which would have strict rules.
JENNINGS BANDB :10 QQQQ: A SHORT TERM RENTAL.
“We can say, ‘look, you have to control your tenants, you have to control them to a particular standard, or you are going to lose tour ability to do a short term rental.”
This was a rare case where Jennings agreed with John Mazza … but Mazza had a whole shopping list of requirements.
Things like requiring each vacation rental to have a local property manager …. as in living in the city of Malibu … to respond to complaints.

“We sit up here every two weeks.
“We worry about whether some house is in somebody’s view … or i is too close to a stream … or has enough parking … or all kinds of stuff.
“On one house … one at a time.
“And then we run into a situation like this … we we are talking about every house in Malibu.”
Last night’s 4 to nothing vote may have showed that the city staff was on a total different frequency than the Planning Commission.
All four commissioners blasted the city’s plan as too permissive … and of not protecting residents who don’t want to live next to motels.
At the same time … the commissioners said well-run vacation rentals are welcome … but they will have to abide by firm rules and strict enforcement.
446 Malibu Spaces Could Get Meters
City engineers are proposing to add as many 446 parking meters to Malibu.
Not necessarily 446 parking meters … some of the spaces could be handled withone machine handling multiple spots.
But 446 parking places are listed by the city as possible metered spaces….
If that’s the way the city council wants to go.
Malibu is virtually the only major beach city in California that does not operate parking meters in places along the coast.
Meters are possible …. the city manager says … along Rambla Pacifico and Rambla Vista in eastern Malibu.
At the Civic Center … Cross Creek Road … Civic Center Way and Malibu Road.
Heathercliff Road near the post office on Point Dume.
At the Point Dume headlands.
And along Westward Beach Road … where 142 existing parking spaces may be soon be bolstered with 33 new spaces … if angled parking is implemented.
City officials say parking meters are not a major revenue source … but some money raised can go to street improvements.
The major idea is to prevent people from parking for long periods of times … which hurts business operators and makes it hard for Malibu residents and tourists alike to park on the streets.
But it should be noted …. no parking meters are proposed for anywhere on Pacific Coast highway ….
City May Ban Overnight Parking of Oversize Vehicles
The city council may also vote to go after oversize vehicles … parked overnight …. on city streets and P C H.
Campers … RVs … trailers … and kayak rental stands would presumably be included.
