The arraignment hearing for Malibu resident Skylar Peak on a misdemeanor battery charge for his alleged involvement in the June paparazzi-surfer brawl on Little Dume Beach was continued today to Oct. 30. His attorney Harland Braun asked Malibu Superior Court Judge Lawrence Mira for the continuance because he is currently working on another case.

As of 9 a.m., the attorney for the other defendant in the case, Philip “John” Hildebrand, had not arrived at the courthouse. The arraignment was scheduled for 8:30 a.m. Braun said the other attorney, Stefan Eric Sacks, was running late.

Both defendants are charged with the same misdemeanor. They face a maximum sentence of six months in jail and a $2,000 fine if convicted.
