In March of 2011, 41-year-old Joseph Annocki was riding a motorcycle when he was struck and killed by a car leaving Geoffrey’s Restaurant on Pacific Coast Highway. He died at the scene.

An appellate panel has now allowed the family of Annocki to file a suit against the restaurant for not having a sign warning drivers not to turn left onto PCH when exiting the parking lot, according to a report by Metropolitan News-Enterprise.

Annocki’s parents had sued the restaurant, as well as Terry Turner, the 50-year-old man from Oklahoma that struck and killed Annocki. Los Angeles Superior Court Judge Amy D. Hogue ruled that the restaurant had no duty to place warning signs. Justice Jeffrey Johnson from the Court of Appeal, stated that the restaurant may have a duty to put up the signs.
