I am not a lawyer, but it sure seems like there has been no case made in the technical memos of the Regional Water Quality Control Board that Malibu onsite wastewater treatment systems are the source of bacteria excess in Malibu Creek or in the ocean.

On the other hand, the board has ignored study after study using a variety of new analytical methods verifying that fecal indicator bacteria (FIB) shoreline monitoring in Malibu is more likely natural and not of human origin. There is one exception, Paradise Cove, and that poorly regulated and unsupervised situation is the Regional Board’s albatross.
