Traffic is terrible for a second day … on PCH at Malibu Lagoon … Caltrans bridge work there.
Another fatal crash on PCH last night .. a one car rollover near Decker Canyon Road.
Engineers are looking at a hillside that keeps dumping rocks on Kanan Dume Road at Troutdale.
Criticism over the pace of sand replacement at Broad Beach.
And the city staff says … there won’t be more traffic from a hotel development … because we don’t measure traffic there.

Here’s what we know as of 9 a-m:
There was another fatal crash in Malibu last night.
A single car rolled over on PCH west of Decker Canyon Road last night at 10:20.
Details are not available at this hour … as traffic detectives have not filed their report yet.
But at least one person was killed in the wreck … in the 33 thousand 5 hundred block of west P C H in the city of Malibu.
Five fire trucks and a fire helicopter were dispatched to the scene.
And the coroner was called out.
That would be the second fatal crash of the year …. but the first within city limits … in Malibu.
On Saturday … a motorcyclist was killed and his passenger critically injured in a crash with a car … just outside city limits at P C H at Leo Carrillo Beach.

There was also a minor car crash at 5:48 this morning at P C H at Busch … but that one was taken care of in a few minutes by the county firefighters.

A hillside on Kanan Dume Road has let loose, again, and rocks have spilled down onto the road.
This is on Kanan Dume Road … on the hillside north of Troutdale . south of Cornell Road.
Traffic was getting through last night … but there were CHP officers and LA County roads people working there with heavy equipment … on the roadway removing rocks.
The county last night sent out engineers to evaluate if the road is safe.
the road is open … with some traffic cones and dirt on the right side heading towards Malibu.

The Malibu City Council is going to tackle a proposal next week .. to allow the hotels on Billionaires beach to put their parking lots down the street … across P C H.
The request comes from the owner of the Malibu Beach Inn … to allow it to replace its parking lot … with a swimming pool.
The cars would be parked … by valets … across PCH in a parking lot down the street from the hotel.
The city planning commission balked at this …. they had questions … like … how would this affect traffic on PCH????
And here’s the city staff’s reply….
“The development of new, offsite valet parking lots as part of any existing hospitality use is not likely to generate significant numbers of additional vehicle trips” if the hotel itself is not expanded.
The city staff report on the proposed offsite parking plan does not estimate the impact of additional cars or people crossing PCH between intersections.
The city staff continues to say …. traffic conditions can only measured at intersections.
There are no intersections in the central Malibu business district … it’s two miles between intersections there.
So …. the city staff says there would be no impact on traffic if cars were suddenly being shuttled back and forth across the highway by valets … and if the valets were crossing the road on foot.
But … no traffic projections were actually made.
That’s because our city measures traffic jams only at intersections …. and if bad traffic develops -between- intersections …. that doesn’t count.
The city doesn’t measure bad traffic between intersections.
And … it’s two miles between intersections near the hotels.
Malibu’s Planning Department has been criticized for years by many residents … over the way it estimates traffic impacts by commercial developments.
Its traffic counts and traffic planning came in for ridicule several years ago … when during the Whole Foods controversy the city’s traffic engineer repeatedly maintained in public … that traffic in Malibu has not increased over the past 10 years.
Tell that to motorists.
Analysts have asked the city planning department …. why it has never done traffic counts on any Sunday … or on any day with heavy beach traffic.
Now … the same traffic staff says heavy traffic doesn’t exist unless it is at an intersection.
We’ve asked city planning director Bonnie Blue for comment on this …. no reply yet … we’ll let you know.

Unhappiness is mounting in Malibu West … over the progress or lack of progress on the Broad Beach sand replenishment project.
The homeowners along Broad Beach have taxed themselves to replace the disappearing beach … with thousands of truckloads of sand projected to arrive starting this fall.
But one of the properties along the beach … which has been assessed to pay for the new sand … is the Malibu West Swim Club.
That’s the homeowners association … which has mandatory dues for about 85 homes in Trancas Canyon and a beach clubhouse … on Broad Beach.
Mikke Pierson … who is also a Malibu ctiy planning commissioner … represents Malibu West … and he appeared before the city council last week with this observation.

“To date they’ve spent $16 million, $6.5 million on engineers, $3.5 million on attorneys, and as you are probably aware, not a grain of sand is anywhere in sight.”
The Broad Beach sand guy is Ken Ehrlich … attorney for the Broad beach residents.
He tells KBUU News that sand will arrive this fall … either by barge or by truck.
He said the beach district is 1 to 2 weeks away from a final agreement on a sand source and delivery means.
And in a statement to KBUU News … he says the sand district is … quoting … “proud to have accomplished the issuance of a Coastal Development Permit from the California Coastal Commission and a Lease from the State Lands Commission.”
The district … he goes on to say … “is on the cusp of receiving the final permits necessary to implement the Project—permits from the Army Corps and the Regional Water Quality Control Board and (they) anticipate issuance of those permits within 60-90 days. “

Ehrlich agrees … the the costs have been significant … and the beach residents well understand the concerns of its owners, the Malibu West residents, and others over cost and the schedule.
Actual construction work will begin this autumn …. on Broad Beach.
But Mikke Pierson scoffs at that.

“Pfftt. I don’t personally think it’s ever going to happen, I’m a little bit worried about that. I think if it’s going to happen, barging it in is the only way it might happen.”
We’ll find out about that … in two weeks.

Pepperdine University announced today that tax law expert Paul L. Caron will become the dean of its law school.
Caron takes a seat once held by Kenneth Starr … the now disgraced ex-president of Baylor University … and the special prosecutor against President William Clinton back in the 1990s.
Caron is decidedly less controversial.
He’s a tax law professor … he came to the law school in 2010 as a visiting professor.
He takes the deanship from Deanell Reece Tacha …. who is retiring.
She was the first female dean of the Pepperdine School of Law.

Today is election day.
Measure H … the quarter cent tax for the homeless for L A County … is the only item on the ballot here in Malibu.
Polls at Malibu High School have been relocated for the first time in years.
People in the two precincts along Zuma Beach will be voting at the Point Dume Club clubhouse this year.
