Another night … another helicopter circling western Malibu last night.
Both the city and Malibu Township Council claim victory at the Court of Appeal.
The city’s retail sales mix comes back before the city council.
And a rare whale is spotted off Malibu.
This is Malibu’s only local daily news.
It’s the Friday edition of the news … from Radio Malibu …. 97 point 5 K B U.
Good morning Selfridge Drive.
Would You Believe, Missed It By -That- Much ?
The drizzle was a fizzle in western Malibu … but it actually rained in Los Angeles this morning.
Record heat is three days away.
A possible moderate Santa Ana wind should produce record setting hot temperatures Monday and Tuesday.
Highs of 106 degrees are possible in the Santa Monica Mountains next week.
Third Visit By LASO Chopper In A Month
Another sheriff’s helicopter visit to western Malibu again last night … sheriff’s deputies say there was a reported burglary in the Broad beach area.
A containment area was set up by sheriff’s deputies.
No one was caught.
This was the third sheriff’s helicopter involved burglary in the area in three weeks …. an unusual cluster of such events to the say the least.
The first two were unrelated … one was a pair of burglars who took an Uber out to Malibu … the second was a beach drifter who broke into a house and awakened a terrified woman.
City And Malibu Township Council Both Claim Victory
Both sides are claiming victory … after the California Court of Appeal issued a ruling on the lawsuit filed by the Malibu Township Council over the Bluffs-Charmlee Park negotiations.
It’s a complex case … over the way that the city council handled negotiations between it and the Santa Monica Mountains Conservancy and M R C A over Bluffs and Charmlee parks.
The city attorney claims that — and we quote — “the bottom line is that the City prevailed in all matters involving (the Township Council’s) alleged violations” of Open Meeting Laws involving the parks issue.
Frank Angel … attorney for the Malibu Township Council … says the Appellate Court agrees with his group … in one key area.
That is whether a closed-door discussion by the city council … over settling part of a lawsuit filed by M-R-C-A … should go to trial as a possible Open Meeting Law violation.
In the new decision … that matter was sent back to court .
The Malibu Township Council may take this up to the state Supreme Court.
It’s a complicated issue … too complicated for radio to be honest … so we’ll post the statements from both sides … plus the court’s ruling … on the KBUU Newswire later today.

Chain Store Regulations, Chapter 2
The issue of chain stores will return to the city council soon.
Several years ago … growth opponents in Malibu led by actor Rob Reiner put before voters a measure that would have restricted chain stores in Malibu … and put new shopping centers up for votes.
The voters approved … but the state courts ruled both the chain store restrictions and public votes of that … unconstitutional.
And since then … the bottom has fallen out on retail industry… nationwide.
For the first time ever .. Malibu’s shopping centers have extensive vacancies.
Many of the high end stores that expanded here have closed their doors.
With that background … the city attorney has crafted a new retail ordinance that would restrict chain stores in shopping centers.
Stay tuned for the debate on that one.
Rare Right Whales Visit California Coast
A very rare whale … called a right whale … has been spotted off the coast near Malibu.
There are only about 30 right whales left in the eastern North Pacific … and they’re usually found near Alaska.
But two different right whales have been spotted off Southern California … one off malibu … and a different one near La Jolla.
Experts say seeing one right whale in Southern California is very rare … seeing two this year has been a surprise.
With such a small population … scientists say its possible that the Malibu coast is on the right whale’s yearly migration path … but we see so few of them that we simply never knew that.
Sea World Lays Off 79 San Diegans After Malibu Protest
And the spiral at Sea World continues.
A nationwide boycott was sparked in part by Malibu school children protesting about orcas … also known as killer whales …being kept in captivity.
SeaWorld San Diego announced Wednesday that 79 jobs at the park will be cut.
The downsizing was achieved through both employee layoffs and leaving open positions unfilled.
Nationwide … SeaWorld is eliminating 350 jobs.
SM Runway Shortening Starts Tonight
Work to rip up the runway ends at Santa Monica Airport is scheduled to begin today.
The City is shortening the runway from its current 5 thousand feet in length to 35 hundred feet.
Aviation interests have lost their last court restraining order against the project … after a federal judge agreed that shortening the runway will increase safety at the airport and in its surrounding residential neighborhoods.
