Oyster Bar Built On City Street – Pier-Area Kayak Guy Lawyers Up – County May Ban Foam Take-Out Too

The owner of a beachfront restaurant builds an oyster bar … on city property. 

And that guy who rents surfboard … says he has a right to run his business on the state highway.

What is neighborhood character … and does it mean another large house will be rejected???

And L-A County may join Malibu …. and adopt the city’s ban on Styrofoam and other plastic take out boxes.

The owner of the Malibu Surf Shack has lawyered up … to fight city efforts to remove two large trailers that have been permanently parked on P C H at the Malibu Pier.

The owner … Sean Weber … has angered nearby business-owners by converting part of the state highway into storage space and signage for his surf shop and kayak rental business.

Weber has parked two large trailers on the state highway … on a 24/7 basis … for years … occasionally switching the two vehicles so as to obey the 72 hours parking limit. 

The city has decided to enforce a law that’s been on the books for 26 years … which allows the city to ban parking between 2 and 4 in the morning. 

Weber has hired an attorney … who has asked the city council to overturn the overnight parking ban ,… before the signs are posted. 

Weber’s attorney says the overnight parking ban runs afoul of the Coastal Commission rules .. that say the city cannot restrict beach visitor parking. 

But the city says it’s Weber … who is in essence hogging parking spaces that could be used by coastal visitors.

Some people who live on the P C H near the pier are also not happy … because they and their guests have been parking overnight on P C H for decades.

The city council gets this hot potato next week.

An oyster bar has been built onto a city street …. and neighbors are not happy about that.

The Sunset Restaurant has been caught expanding well beyond its property lines … and the city of Malibu is confronted with a mess.

A nasty-looking dirty linen bin … a truck loading zone … and the part of the oyster bar are all encroaching onto Birdview Avenue. 

The oyster bar section of the restaurant was built years ago … without any city permits at all.

385 square feet of it are on city property.

The restaurant owner has also removed five parking spaces along Westward Beach Road … and converted them to valet parking only.

And … about a half dozen parking spaces in the Sunset Restaurant’s parking lot have been removed … illegally … and enclosed with some sort of structure. 

The city last December forced the restaurant owner to agree to clear up the violations. 

Eight months later …. the Planning Department wants to ask the city council for direction on this matter. 

That also goes to the city council next week.

What is community character … and what does that mean for people wanting to build houses in Malibu???

That question has been roiling around City Hall this summer …. after the city council rejected a proposed house off Kanan Dume Road because it was too big for the community character.

The property owner on Via Acero was told: come up with a smaller house that meets the neighborhood character.

That left the city planning commissioners publicly unsure of what to do with large houses …. coming up for approval before the commission.

Against that backdrop comes a proposed house on Portshead Road … larger than others in that corner of Point Dume.

A neighborhood squabble erupted on a social web site. 

For the record … the city planning staff has inspected the lot … and the rest of the neighborhood … and says the house 10 thousand square foot house does not disrupt the community character. 

The whole matter goes before the Planning Commission tonight.

Malibu was one of the first cities in California to ban polystyrene, the type of plastic found in many take-out food containers.

The plastic … also called Styrofoam … pollutes the ocean. 

Huge amounts of the foam wash down flood control channels.

The state legislature was considering banning the polystyrene statewide … but that ran into powerful and rich lobbyists in Sacramento.

So now … L-A County is making a move. 

The Board of Supervisors has asked L-A County Public Works to study the feasibility of banning or restricting the use of polystyrene food service ware throughout unincorporated areas of the County.

Supervisors Sheila Kuehl and Janice Hahn both represent beach districts … and are in favor.

We’ll see if they get a third vote from one of the inland area supervisors …. on the proposed Styrofoam ban for food containers in unincorporated county areas.

Santa Monica College has become the first community college in Southern California to grant two-year college degrees in Early Childhood Education.

A national agency has just accredited the SMC program.

The two year program at Santa Monica College also satisfies most of the California State University lower-division requirements … and offers students priority admissions consideration at select CSU campuses.

The National Association for the Education of Young Children has just approved the Santa Monica College program.

S M C is the second community college in California to meet the accreditation requirements.

Average temperature data for our area … for last month … are out.

And July was hot … really hot.

The average temperature in Woodland Hills … the mean temperature around the clock …. for the last 30 years was 76 degrees.

But this July … that average temperature was 81 …. 

And the average high at Woodland Hills was 98.

Average temperatures across Southern California were three degrees above the 30-year average.

In the ocean … it’s ((((    70    )))) degrees in the water at Zuma Beach.

The lifeguards say the waves today are   ((((  1 to 2  )))) feet high …. 

((((  out of the south southeast.  )))) 

Those are ((((  poor to fair )))) surfing conditions …. according to the lifeguards.

(((((  A minor  tide is at  10:43 this morning … 4 feet.

Low tide is at 3:46 this afternoon.

The major high tide is tonight … at 9:55 … it will be 5.8 feet high.
