I purchased my home in Malibu Country Estates in 1978. With the able assistance of nine neighbors, we organized a formal homeowners association of which I was first president. The staff of the city, plus two brilliant neighbors and I spent three labored years drafting the design for Malibu Country Estates Overlay District Ordinance Numbers 122 And 150 which the City Council adopted in 1995 and 1996.
At this point I am dissatisfied with the proposed zoning text Amendment No. 05-005 that needs extensive revision.
The city must become proactive and not leave it to the aggrieved party to appeal to the county where unfortunately those with deepest pockets will usually prevail. The city needs to step up to the plate and write a view restoration and preservation ordinance to protect the ocean views of all residents. Otherwise the sign will read, “Malibu, 27 miles of scenic beauty for the privileged few.”
Malibu Country Estates was specifically designed with numerous height restrictions for structures, hedges, walls, etc. The trees should be no taller than the roof lines of the homes. There also needs to be restrictions if trees are placed on differing levels so they do not interfere with their neighbors’ ocean views.
I am requesting that the Planning Commission send this ordinance back to staff with numerous community suggestions for a rewrite. A citizens group could be formed to help staff with this task. Remember, the City of Malibu needs to serve and protect its citizens. That is the number one priority.
