Nobu Will Get Its Permit Yanked If It Doesn’t Fix Parking Issues: City – Kayak Store Complaints – Cemetery Clears Final Hurdle Maybe

The City of Malibu is coming down hard on Soho House and Nobu.

And a kayak rental shop that’s parked its trucks permanently on P C H is also the target of residents’ anger.

Sad news from the Santa Monica Mountains … two mountain lion kittens have died … natural causes this time.

This is Malibu’s only local daily news.

It’s the   ((((  Tuesday  ))) edition of the news … from Radio Malibu  …. 97 point 5 K B U.

Good morning Malibu!

——

The city of Malibu has started moves to shut down Nobu restaurant … but is giving the owners of the trendy restaurant one last chance to alleviate parking and traffic woes at the Billionaires Beach property.

Nobu had illegally expanded its allowed 222 seats by 58 percent …. to 342 seats.

Nobu and its neighbor …. Soho House …. have been infuriating their neighbors with employees parking all day and all night in front of their homes on P C H.

Also … the parking valets have been buzzing back and forth across P C H to park patrons’ cars off the property … something that the city says is not allowed.

Last Thursday … Nobu removed the extra 120 seats in an outdoor patio area that had been illegally created in a patio area …. bring it into compliance with its 222 seat limit.

That lead to talk last night about revocation of the Nobu permit …

Here’s city planning commissioners John Mazza and Steve Uhring.

BEGIN SOUND ON TAPE.

MAZZA: “As far as I read our codes,  you cannot cause a public nuisance.”

UHRING: “Let’s assume we go the revocation route,  just for discussion, if that happens, how fast can they come back after that permit is revoked??”

END SOUND ON TAPE.

Nobu and the Soho House have lawyered up .. and begun cooperating with the City of Malibu.

And their lawyer … Ken Ehrlich … says he wants to work with the city … but is upset that planning commissioners said they are out of patience with Soho House and Nobu.

BEGIN SOUND ON TAPE.

“I’ve never ever been a part of a hearing of any commission or public body in the city where I felt as if my client was prejudged more than I felt in the last few minutes of this commission.”

END SOUND ON TAPE

City staff had basically been ignored as it tried to work with Nobu on the overcrowding … and it wasn’t until last Thursday that the restaurant removed 120 seats from its patio.

It is allowed 222 seats under its city permit.

Nobu had overshot that by 58 percent. .

And it has been caught red handed … parking cars across the highway … also in violation of its permit.

City staffers want to give the club and restaurant one more chance to live within the rules.

And they said they need 10 weeks to work that out.

But planning commissioners said the issue cannot fester all summer.

They told Nobu to fix the parking problems … now.

And to that … Nobu attorney Ken Ehrlich says …

BEGIN SOUND ON TAPE.

“We hear everything that was said tonight loud and clear.

“To the extent that employees continue to park on PCH despite the admonishments of management, management will take care of that with its own employees.

“For both Soho House and Nobu.”

END SOUND ON TAPE.

Bottom line: Soho House and Nobu are on notice … clean up their parking mess by August 21st  … or they face a revocation license fro Nobu and sanctions for Soho House.

And right next door …. the Malibu planning commissioners last night approved a new parking rule for the area right on front of the Malibu Pier … where a local business is accused of hogging public parking with a pair of long van and trailer combinations.

The business …. Malibu Surf Shack … has in essence moved its business storage  area onto the highway …permanently …

John Stockwell and his wife run the Malibu farm restaurant … at the pier.

BEGIN SOUND ON TAPE.

“This is a chronic issue.

“You have merchants that park their vehicles there 24/7.

“They know the game … they play it.

“They play it very well and very effectively.”

END SOUND ON TAPE

Another neighbor … Jonathan Roth …

singled out the offending business.

BEGIN SOUND ON TAPE.

“It’s vehicles from the Malibu Surf Shack, a van and trailer that they parked on both sides of the street

“And what they do now is, I guess that rules are that they have to move them every 72 hours, and what they do now is they just swap them from one side of the street to the other.”

END SOUND ON TAPE.

No one from the Malibu Surf Shack spoke …

One major hole in the proposed parking change.

The new ordinance would require a vehicle to be moved … at least once … during the hours between 2 and 4 in the morning,

It doesn’t say how far they have to be moved … they could be moved a few inches.

The owner of the business has already figured out a way to game the system .. deputies said.

——

And with barely any discussion …. the Planning Commission gave final approval to the proposed Malibu cemetery on a 5-to-nothing vote.

The decision is the final vote on the matter …. unless someone appeals it to the city council or the state coastal commission.

The CHP now says the minivan that went over the cliff on Kanan Dume Road was registered to a 45-year-old Woodland Hills man.

But it’s not known when … or even if … a  crash happened …. ,

And it is not known if the human bones found scattered in the area were those of that man.

A minivan and scattered human bones were discovered 150 feet down a cliff below a road in the mountains above Malibu on Sunday.

The van was not seriously damaged … even though it was 150 down a near-vertical slope.

They found a Kia minivan “on its wheels, with very little damage,” … according to C-H-P officer Leland Tang.

The van’s license plates traced back to a Woodland Hills man last seen in March, he said.

Near the van … scattered human bones … possibly disturbed by foraging wild animals.

That canyon is home to coyotes, cougars and wildcats known to scavenge human remains.

Tang says investigators “determined that the person had exited the van on his or her own,.

“`Whether he or she had driven down there, or if there had been some sort of crash, we don’t know.”

The coroner’s office removed the bones and was analyzing them for an identity and cause of death.

And depending on what they find .… there is either a C H P traffic accident case … or a county sheriff’s homicide investigation.

Two mountain lion kittens born in the eastern Santa Monica Mountains have been found dead.

The kittens were apparently abandoned by their mother.

Biologists with the National Park Service say the two mountain lion kittens had been tagged int their den …

The kittens father had been in the area …. and mountain lion males are known to kill their offspring.

Biologists say they have seen female mountain lions leave their den with another male, seemingly to distract him from preying on the kittens, and will then return and move the kittens.

That didn’t happen this time.

In news from up the coast …

Archaeologists working on Santa Rosa island … 40 miles west of Malibu … have discovered stone tools that are more than 8 thousand years old.

And they found them under a historic ranch house.

The 150-year-old ranchhouse is part of the historic Vail and Vickers ranch, and it turns out it is sitting on top of the significant archaeological site.

The Ventura County Star reports that archaeologists have discovered stone tools characteristic of sites occupied 8,000 to 13,000 years ago.

Archaeologists found a distinctive stone called a Channel Islands barbed point; then later, they discovered a crescent.

The Chumash people and their ancestors have been on the islands for thousands of years.

Arlington Man is the earliest known human remains in North America.

Those remains date back 13,000 years and were found nearby on Santa Rosa Island.
