The Malibu Planning Commission voted 3-2 Tuesday to approve a conditional use permit for Malibu Collective Caregivers to become the city’s second medical marijuana dispensary.
A competing medical marijuana application by Joshua Krane of the proposed Twin Lyons Wellness center was denied by a 4-0 vote due to a city law that limits the number of dispensaries in Malibu to two. Chair John Mazza abstained.
Malibu Collective Caregivers will be located in an existing building at 22235 Pacific Coast Highway behind Giovanni restaurant. It joins PCH Collective as Malibu’s second medical marijuana dispensary.
The application by Malibu Collective Caregivers was heard first, because its application was deemed complete by city staff about two weeks before the other application. Once it was approved, the commission had to deny the other application due to the two-dispensary limit.
Krane told the commission that there had been a miscommunication. “We entered into this thinking that both applications would be heard and that you would then be in essence voting on what was best for the community,” Krane said. “Had we not been given that information we would have proceeded with a very different game plan.”
