Biker Rally Told: Share The Ride On PCH – Oyster Bar Gets Take Out Order

Bikers are told … their rally has to follow rules from the sheriff’s office. 

Overnight parking is banned next to the Malibu Pier … where a business is hogging primo spots. 

And a restaurant is told by the city attorney … get your oyster bar off of our property.

Good morning Cavalieri Road.

The owner of the Malibu Surf Shack last night was told by a unanimous Malibu City Council… no … you don’t get to park your trailers in eight primo parking places on PCH at the pier … on a on a 24/7 .. 365 day a year basis. 

Surf Shack owner Shawn Weber was told that he will have to move his trailers off the road every night … between 2 a-m and 4 a-m. 

The ordinance is not officially aimed atthe Surf Shack’s trucks.

But that clearly is what’s behind this.

The idea is to free up parking for visitors … who don’t get to park on the state highway because the Malibu Surf Shack is storing its kayaks in trailers …on the public road. 

Weber says it’s safer for tourists … who rent his kayaks… to not to have to cross P C H from his store to the beach.

“I have vigorously tried to do something to keep people safe and available and to having things for people to be able to come here and enjoy their time in Malibu.” 

The Surf Shack’s lawyer maintained that the city cannot restrict coastal parking … and that banning overnight parking is illegal.

Sheriff’s lieutenant Jim Royal disagreed.

“It’s not a restriction. 

“It is a tool for law enforcement to prevent abuse of people who violate by parking 24 seven 365 in what should be a public parking area.”

Sometime soon … parking in the pier area will be banned on PCH between 2 and 4 a-m.

Sheriff’s deputies have said they will not be surprised if the malibu Surf Shack trucks and trailers find their way into the primo parking spaces anyway. 

The decision was a 4-0 vote … councilman Jay Wagner was accused by the Surf Shack’s lawyer of using his city power inappropriately.

Wagner owns a competing surf shop down the road … and noted th eparking crackdown came before he was elected to city council.

Nonetheless … Wagner stepped down from the hearing and vote.

Plans for the Ride To The Flags motorcycle rally were endorsed by the city council last night … but exactly what those plans are … have not been finished. 

The organizer of the ride … Ryan Sawtelle … was rebuffed in his efforts to get permission to close P C H for an estimated 18 minutes … in a rolling blockade … on that Sunday … September 12th.

Sheriff’s deputy Mike Rains … who has ridden in the bike rally nine times … says the sheriff’s department is behind the event and the veterans riding.

He told the city council that rally’s plans to close the road for one massive motorcade are not safe.

“The are three core issues of public safety that we’re worried about tho.

“The first being the taking of the intersection. 

“The second being, he amount of time that the intersections are held. 

“And, then the traffic congestion at Malibu Canyon and PCH, where everyone arrives at one time.”

But the rally’s professional organizer … Ryan Sawtelle … says the profits going to pay medical expenses for a wounded warrior should override any complaints.

“ I would think that holding an intersection for 7-8 mins on a Sunday morning is a little bit of an unreasonable complaint given what it is doing positively — not for a foundation necessarily, but for one warrior in particular.” 

In the end … the city council told the bike rally organizers they need to break up the rally into segments … to allow motorists to use PCH during the rally …  and not all arrive at Bluffs Park at the same time. 

Ride To The Flags organizers and the sheriff’s deputies said they will work together on a plan to reduce the safety hazards … and traffic delays.

The Malibu city council last night had two unusual cases … of what to do about businesses that seek to make deals  with the city.

In the Civic Center … the owner of the La Paz shopping center was told the city might be interested in making some sort of deal about joint parking .. but Mayor Skylar Peak was adamant that the proposed shopping center would not get any additional square footage.

And at Westward Beach … the owner of a wayward restaurant came hat in hand to seek a solution to his embarrassing problem.

The Sunset restaurant is built 15 feet onto city property.

Architect Don Burdge says the city should allow the restaurant to maintain its 75-hundred square foot size … while moving off the city property. 

The owner … Franco Simplicio … was proposing the build public restrooms … and a take-out window for beach snacks … in exchange for being allowed to keep his restaurant about the same size … or slightly smaller … 

That’s even after he removes the 385 square feet of oyster bar that was somehow built on city property or Birdview Avenue. 

City attorney Christi Hogin says the southern end of the restaurant has got to go.

“You can’t decide to let somebody violate the law, you just can’t. This is an encroachment that has to be removed.”

The restaurant owner was rebuffed by a consensus of the city council … when it came to his offer of allowing the public to use restrooms and a viewing deck. 

Mayor Skylar Peake says the only public improvements he wants from the Sunset Restaurant … would be for the owner to chip on for building a beachfront walkway and putting in angle parking on Westward Beach Road. 

The owner of the Sunset and city staff will try to come up … now … with a plan to get that oyster bar off city property.

City of Malibu repaving contractors will be working again today ,,,,

This morning … the east side of Trancas Canyon Road will get slurry coating in the morning. 

The west side of Trancas Canyon Road will be repaved in the afternoon. 

And on down at Free Zuma … the west side of Westward Beach Road wil be repaved today from 9 to 2.

On Point Dume … the east side of Birdview Avenue will be repaved from 11 a-m to 4 p-m .

In Santa Monica … the city is opening up a waiting list for affordable housng units.

On Thursday morning … Santa Monica will accept applications from people who live or work in Santa Monica. 

This wait list is for moderate-income earners who live or work in the city.

And who is eligible???

Single people who make less than 75 thousand dollars a year … or 86 thousand 5 hundred for a couple.

Santa Monica usually requires developers of new housing to set aside units for people with lower income. 

The city typically has between 150 and 200 units available a year to moderate-income earners . according to the Santa Monica Lookout newspaper.

Applications to live in cheap rent apartments in Santa Monica are available on line … we’ll have the link posted on t he KBU Newswire this morning. 

Affordable housing is based on 30 percent of the designated income category for the apartment. Apartments affordable for very low-income households, for example, have a rent limit of around $900 for a one-bedroom apartment.

School’s start in L-A always changes traffic patterns in Malibu and on the west side.
