The real estate industry statewide was apprehensive that a case presently before the California Supreme Court might change the rules of the industry. In a time when many companies have consolidated and have many offices in many places, the Supreme Court decided that it was still legal and proper for one company, in this particular case Coldwell Banker, to represent both buyer and seller. However, the court did make a change and hold that a sales person working with a seller owes a fiduciary duty to disclose known material facts to the buyer. Whether or not that was done in this case will be determined when the case returns for trial again.
