Hillside houses blight landscape

Malibu hillsides are dotted with too many houses that stick out instead of blending into the landscape, according to Planning Commissioners who want to prevent further visual blight.

The commission met Saturday to discuss making changes to current zoning regulations that would limit the size and appearance of future hillside development. Along with a building’s bulk and size, other visual concerns such as color choices and landscaping were addressed.

These concerns have become a high priority, with more than 210 projects moving through the city’s permit pipeline, according to Planning Director Craig Ewing.

“In the next three years, probably all of Malibu development will be coming before us because of the economy, so we need to set some guidelines,” said Commissioner Charleen Kabrin.

Those guidelines are meant to prevent the type of projects that the commission has heard so many complaints about from longtime residents. Commissioner Jo Ruggles provided those at the meeting with photos of the worst examples. They included two-story houses with large basements creating a three-story appearance, as well as white houses with red-tiled roofs. “If we can see them and they [the residents] are complaining, then we’re doing something wrong,” Ruggles said. She believes the city has abandoned a land-use policy that “blends development with the natural topography,” as expressed in the city’s General Plan.

Ewing challenged Ruggles’ contention that the city was largely to blame. He explained that most major hillside projects constructed since Malibu became a city were approved under county zoning, fire rebuild or overlay standards. “What we’re seeing now is a lot of projects built today built under county zoning rulings, not city. But they are valid. They are county-approved projects we have to allow,” Ewing said. He explained that there are some county-approved projects that haven’t even begun yet.

Despite having only a few examples of projects built under current zoning regulations, the commission decided to debate certain deficiencies in the code.

For one thing, “size does matter,” quipped Commissioner Lipnick, who was referring to the penchant of homeowners to build as much square footage on as much land as possible. One solution considered by the commission is public review of hillside projects that exceed a certain size. Exactly what size would be determined after receiving a recommendation from Ewing, who will first discuss the matter with his staff and design professionals in the community.

Decisions about size are currently made at the city staff level, and local architects who attended the meeting favored keeping this approach. Local resident and architect Lester Tobias explained that the city staff is made up of professionals who are well-qualified to make such decisions. Tobias also expressed concern about the added costs and delays of creating another level of bureaucracy, which Ewing estimated would amount to an additional two to six weeks before project approval. “It [already] costs a homeowner $15,000 to figure out if he can build a guest house,” warned Tobias.

Directly related to the problem of size is the trend toward building large basements. The current code limits buildings to two stories, but basements are not counted as a story. The code doesn’t even define “basement.” Too often, the result is a basement that looks like another story and is used as another living space instead of for storage. Ewing said he would provide alternatives for solving this problem.

Responding to complaints about the jarring visual impact of white houses with red-tiled roofs, Kabrin wondered, “Should we legislate attractiveness? What is reasonable here?” There is presently no regulation of color.

Commissioner Ken Kearsley expressed reservations about stifling freedom of expression, “I have a hard time saying, ‘Hey guy, you can’t have a red roof.'”

Trying to reassure the architects at the meeting, Lipnick said, “We are not here to restrict your creativity, but what we are here to do is protect the important values of the community.” A decision on the matter was postponed until later.

The thorny issue of landscaping was also addressed. The current code’s main concern is that plants not obstruct views from other properties. Commissioners felt that another consideration should be the view from the PCH, with plants helping to soften the look of buildings on the hillside.

Ruggles said, “We want to keep the neighborhood the same. The code allows more than what the community wants.”

The next meeting of the commission is set for 6:30 p.m. Aug. 3 at HRL.

For the first time in the history of Malibu Little League, a 9- 10-year-old All-Star team won the District 25 championship. The squad staged an amazing comeback, beating Culver City 14-2 July 21 to win the two-week double elimination tournament.

The team had lost its first game 7-6 to Playa Vista and had to travel through the loser’s bracket to reach the championships. The team won the next seven games in a row to capture the crown.

The team batting average for eight games was .470. The team averaged 10.5 runs a game. The team scored 84 runs to the opposition’s 39.

The pitching staff threw two one-hitters and repeatedly shut down the opposition at the most important moments.

The team included Brett Weinstock, Jason Puklus, Brooks Fitch, Travis Turek, Grady Berk, Jamie Van Soelen, Colbie Bell, Alex Berrios, Matt Hale, Jake Mizrahi, Kelly Jacobson and Patrick “Pac-Man” Stoker. Manager John Puklus and his coaches Steve Weinstock and Tim McAlevey did a great job of preparing these young athletes for the post-season tournament.

In the second game against Beverly Hills, Fitch threw three innings and gave up one hit. Puklus pitched for the first time this year and put in three innings of no-hit ball to record the save for Brooks. Turek and Brooks got two hits each and Mizrahi had a nice single and scored an important run. The team dominated the game and won easily, 8-0.

In game three, West Los Angeles took a 13-4 lead after the third inning. Eight Malibu runs crossed the plate in the fourth inning to make the score 13-12. Bell slashed a big triple to right. The inning was highlighted by an important hit from Mizrahi and a booming double by Turek. WLA scored two runs in the top of the fifth and took a lead of 15-12. With one at bat left, Berk started the inning with a monster double. Van Soelen drove Grady in with a solid single. Three batters in a row walked, then Weinstock drove in the tying run with a solid single to left, his third hit of the game. Puklus came up next with the winning run at third and hit a deep sacrifice fly to right that drove in the go-ahead run. Fitch added another single that drove in the final run to give Malibu a 17-15 lead.

With Malibu still batting and the sun having set, the umpires called time, conferred with the District supervisor and declared the game suspended. Because the inning wasn’t complete, it had to roll back to the previous inning and therefore WLA was declared the winner, 13-12. The announcer added, “But there has been a protest filed by the Malibu manager, and a ruling will have to be made through Williamsport, Pa. Please stand by while they make a phone call.”

It took 20 minutes, but the rule clearly states that if a home team has the lead in a game called on account of darkness, then it is the winner. Malibu was rightly declared the victors, 17-15. It was an amazing comeback and set the tone for the rest of the tournament.

Malibu’s next opponent was North Venice, a perennial powerhouse. Malibu pounded out 15 hits, with Fitch leading the way with three singles and a double. Berrios had a big double and Hale crunched a solid single into right center. Puklus, in his first start in 1998, threw five innings of no-hit ball. Malibu won 11-1.

The fifth game against Culver City National included pitchers who were not scheduled to pitch. Van Soelen pitched three great innings, then Weinstock pitched three innings and struck out five batters Malibu won 12-7, with Van Soelen, Brooks and Weinstock getting three hits apiece. Turek had four hits, including two tremendous doubles. Stoker had two important hits and Puklus, Turek and Van Soelen played a great game on defense. Berk made an important catch in center and the team was on a roll.

Game number six was against Playa Vista, and they were feeling pretty confident that they could send us back to the beach. Fitch, the starting pitcher, dominated them from the beginning. He threw three innings of no-hit, no-run ball and fielded his position like a pro. Turek pitched the last three innings and gave up two quiet runs. Berk led the hitting attack with a double and a single, and Van Soelen went two for two with two RBIs. Berrios, Fitch and Berk had two RBIs each, and Puklus had seven putouts at shortstop. The team won 10-2. The seventh game of the tournament was against Culver City Little League. Malibu sent Puklus to the mound. Again, he responded with a masterful performance, throwing four innings of two-hit ball, striking out six batters. Malibu was ahead 5-1 going into the fifth inning, but Culver City fought back to tie the game, 5-5. Stoker started a two-out rally in the fifth with a hard line drive single. Weinstock followed with a hit and Puklus walked to load the bases. Fitch stroked a hard liner into left and Malibu took a 7-5 lead. Culver City got its first two runners on base, but then Berk made a nice catch in center, Weinstock made a good stop at second and Van Soelen struck out the last batter to preserve a hard-fought 7-5 victory.

These two teams would now play one more game, the following day, for the championship of District 25.

Fitch took the mound with tremendous poise, not to mention his 60 mile an hour fastball, and dominated the Culvert City hitters, and hit the only home run of the 9-10 tournament, a two-run shot in the second inning. The top four hitters in the lineup — Weinstock, Puklus, Fitch and Turek – had three hits each. Jacobson had a nice double and scored a run. Stoker had a double, Berk had two hits. Mizrahi and Berrios had important hits, too. The team dominated Culver City 14-2 to win the championship.

The team effort was complete and Malibu had staged an amazing comeback to win seven straight games.

New owner, new name for Monroe’s restaurant

Monroe’s Restaurant on Westward Beach Road recently changed owners, and to avoid any complications from the estate of Marilyn Monroe, its name has been changed as well. After a short renovation, the restaurant will reopen late August under its new name, The Gray Whale.

Thomas Averna, the new owner, worked for many years as a waiter at Monroe’s and at the other restaurants that occupied the site. He bought the eatery from his sister and brother-in-law, former Malibu residents Donna and Richard Chesterfield.

“I finally saved up enough money to buy the place,” he said.

The restaurant’s previous name, and the photos of the legendary actress that adorned its walls, regularly brought assertions from representatives of the estate of Marilyn Monroe that the restaurant lacked the licensing rights to use the Monroe name. Averna said that Chesterfield defended the name choice by saying he had a relative from his native Great Britain with the Monroe name.

“Richard would always get calls from the estate of Marilyn Monroe,” said Averna. “He would always say he was related to a Welsh tenor named Sam Monroe.”

Because Averna can claim no relation, he changed the restaurant’s name. He also promises new paint and carpeting, and a few changes to the menu.

“But, it will still be fine dining,” he said.

Council ups planning fees

If you’re looking to build or remodel in Malibu, you may want to take a look at a new sign that hangs in City Hall. It notes changes to planning fees that were approved at Monday’s City Council meeting.

Last November, the council directed staff to review and update the fees charged to applicants for planning approvals and to compare those fees with those charged by other cities.

In a staff report, Planning Director Craig Ewing explained that the fee schedule was analyzed from two perspectives. One compared them with the fees of other cities. The second assessed the actual staff hours and resources expended on projects. In his staff report Ewing noted, “Staff believes that the second analysis is most important, in that we want to know we are collecting enough money to fully cover our expenses.” Ewing explained that staff’s objective is to be self-funding — that is, to set fees so that no General Fund money is spent to support the development review process.

Under the new schedule, some fees have been increased and others decreased. The biggest jump was the Major Residential Plot Plan fee, which rose from $810 to $1,365. “That’s our basic application,” said Ewing. “That’s where we do all our coordinating and all our basic zoning work.”

Staff noted that fees were increased because they require more time than previously estimated. Those that were raised include: Master Sign Permits, Lot Line Adjustments, Minor Commercial Plot Plan Review, Tentative Tract Maps and Wireless Facilities Review.

Other applications were determined to require less time than previously thought, and these fees were reduced. They include: Major Commercial Plot Plan Review, Minor Sign Modifications, Zoning and General Plan Amendments, Minor Conditional Use Permits, Tentative Parcel Maps and Archaeology Phase II.

Add-on applications, such as Minor Modifications, Neighborhood Standards and Variances, were also reduced. The Site Plan Review fee, used by people who want a building more than 18 feet in height, was lowered from $975 to $655. This may help offset the Major Residential Plot Plan fee increase. “Most people will come in for both of those,” said Ewing.

As for the comparison, staff determined that while Malibu’s rates were within the range of surveyed cities, they were on the high end. Ewing said that’s because of the city’s complex zoning rules. “We coordinate, in the planning department, more interdepartmental review than any city I’m aware of,” said Ewing. Those reviews include soils and geology, archaeology, environmental resources and zoning.

Ewing said the new fee schedule has been adjusted to ensure that people aren’t being overcharged when requesting more than one review.

Also at that meeting, the council accepted a staff recommendation to “grandfather” in nonpermitted projects but called for creation of an amnesty system under which people without current permits could get them. The council directed staff to provide an amnesty plan for homeowners who voluntarily come in to get their structure legally permitted.

“If it meets all the old county zoning, they’ll be clear of planning,” said Ewing. But the zoning code is different from the building code, which deals with structural things and safety issues. Ewing pointed out that the buildings will not be automatically grandfathered under the old county building code. The buildings will still need a building permit “so that they build the safest structure under the current building rules.”

Volunteers who come forward will pay the usual fee for a permit. Violators are usually charged twice the fee. Ewing said the amnesty program could affect a large number of residents. “We have people telling us that up to half of the homes in the community could have some kind of nonpermitted work done on them,” Ewing said. “We don’t know how much of that is illegal work and how much is just poor county records.”

The staff is expected to bring the amnesty proposal back to the council next month.
