Many residents are still wondering when the trees that were recently planted at 7377 Birdview are going to be taken out. Residents are also wondering why the city staff has not been enforcing the current codes that affect the “View Protection Ordinance.” The development at 7377 Birdview Avenue is in violation of height restrictions stated on the original plan of 2008, which allows a maximum of six foot tall trees even with future growth considered. The developer of 7377 Birdview has knowingly placed dozens of trees and hedge plantings ranging between 15 feet and 25 feet. These trees may grow as tall as the adjacent phone pole.
If the City of Malibu staff allows these violations to remain and a certificate of occupancy is granted to 7377 Birdview LLC, then the whole city planning process will be corrupt and the building blocks for their planned “View Protection Ordinance” will never be enforceable. Granting permits under this condition is promoting and supporting unfair ethics and practices for developing Malibu. Why would the developer’s representative even think of doing this to his neighbors and then convince and expect the city to sanction it?
If this is allowed these developers apparently have found a way to corrupt Malibu for their own financial gain at the expense of others. The city’s planning and approval process will not be doing their duty to residents of Malibu by contradicting their intentions of preserving views of the neighborhood through the “View Protection Ordinance.” I believe that the planning department may not know what they are doing, or are not interested in actually finding out, and therefore should not be attempting to pass the view ordinance in its present form.
