A public notice in the window of the old Savory restaurant space shows the gastropub Duck Dive as an applicant for a state alcohol license.

Editor’s note: On Friday, owners of the Duck Dive in San Diego said they are not affiliated with the Duck Dive looking to operate out of Malibu. They are consulting with their attorney to see whether any legal action will be taken.

A restaurant going by the name “Duck Dive” has applied for a state license to serve alcohol at the restaurant space once occupied by Savory Restaurant at Point Dume Village shopping center in Malibu.

The restaurant space has been vacant since Savory closed last November after a bitter fallout between Point Dume Village landlord Zan Marquis and Savory co-owner and chef Paul Shoemaker.

According to a public notice posted on a restaurant window, Duck Dive Gastropub applied in February for the state-issued license.

When asked for comment Wednesday, Point Dume Village property manager Kathryn Natalia said she had no announcement to make.

“I’m sure there will be lots of press releases and things ready when we know something,” she said.

A restaurant by the same name opened last year in San Diego, but owner Tom Winn said he had no plans to open a second Duck Dive in Malibu. Whoever is behind the Malibu location, he said, was not affiliated with his San Diego operation.

“I’m talking to our lawyers about it,” he told The Malibu Times.

The San Diego location opened last April. It serves pub-style food and alcohol 11 a.m.-2 a.m. on weekdays and 8 a.m.-2 a.m. on weekends.

The public has until March 14 to submit comments or concerns regarding the alcohol license to the state’s Department of Alcoholic Beverage Control at 3927 Lennane Drive, Ste. 100, Sacramento, CA 95834.Â
