This letter deals with the need for a view ordinance in Malibu. For more than two years I’ve tried to persuade the City Council to enact such legislation. I’ve addressed the City Council three times on this matter and the Planning Commission once. Both bodies have received letters from me.
There are a number of other residents who share my need for prompt action by the city government. Unfortunately, the City Council seems to regard this matter with the same indifference that my neighbor does, allowing trees on his property to continue to grow over the years, now denying me the ocean view which was one of the principal reasons my wife and I decided to buy this property.
This state of affairs has left me no alternative but to begin discussion with my attorney with the objective of suing my neighbor for actual damages. It’s a sad commentary on a city government that I helped form in 1991, believing at the time that it would be more responsive to community needs than the county government had been. In this case I’m gravely mistaken.
